An individual can have two jobs with two different employers at the same time, provided the jobs are compatible with each other. In this case the individuals concerned were employed by the Prison Service and were officials of the Prison Officers Association. The individuals received a salary from both the Prison Service and the Prison Officers Association. The EAT found that, in looking at the nature of the roles, there was nothing to suggest that they were incompatible and so the individuals could be, in principle, employees of both the Prison Service and the Prison Officers Association.
