The requirement to notify the Russian antimonopoly authority (FAS) within 45 days after the performance of certain transactions was generally abolished pursuant to amendments to Russian antimonopoly legislation (effective from 30 January 2014). This was done in order to exclude small and mid-sized businesses transaction from FAS supervision.
The post-transaction notification may still apply in certain cases, such as, to intra-group transactions where such transaction was exempt from the requirement to obtain the preliminary consent of FAS for reasons other than meeting certain thresholds (e.g. value of assets, profit, etc.) set out in the Law on Competition.
