Last month, Colorado (H.B. 13-1046), Oregon (H.B. 2654), and Washington (S.B. 5211) became the latest states to bar employers from requiring or requesting that current or prospective employees provide access to their personal social media accounts. As we have previously reported, California, Delaware, Illinois, Maryland, Michigan, and New Jersey put similar restrictions on employers last year, while Utah, Arkansas, and New Mexico followed this spring. Similar legislation is pending in at least 36 other states.
