While agreements with noncompete and nonsolicitation clauses can help a company reduce the likelihood of litigation, they may not be able to prevent all litigation. PNC Bank recently filed suit against three former employees from its brokerage unit for soliciting customers in violation of nonsolicitation and noncompete clauses in their employment agreements. PNC has argued that these former employees solicited customers to move their accounts from PNC to Fifth Third Bank. The case is currently pending in federal court in Illinois. For more, click here .
