The National Agency of Petroleum, Natural Gas and Biofuels (ANP) filed at the claim no. 16.081 at the Supreme Court (STF) challenging the Federal Court decisions, that included the municipalities of São Franciso do Conde (BA), São Francisco do Sul (SC), São Sebastião (SP), Cabo de Santo Agostinho (PE), Cururipe (AL), Madre de Deus (BA) and Guamaré (RN) as the legitimate municipalities to receive royalties for being delivery outlets of natural gas, considering them embarkation and disembarkation facilities for purposes of distribution of royalties. As per ANP´s understanding, the Federal Courts decisions are invalid, inasmuch as the injunction granted by one of the Supreme Court ´s justices in the Direct Action for the Declaration of Unconstitutionality (ADI) NO. 4.917 does not contemplate the provisions of the law that recite the grounds of the claim of referred municipalities.
According to ANP, the Federal Courts´ decisions go beyond the limits of the injunction granted by the Supreme Court (STF), in addition to creating a situation of inequality, inasmuch as there are other municipalities in a situation similar to the benefitted parties that have not been contemplated by the Federal Courts´ decisions
