Delaware Governor Jack Markell (D) signed legislation (S.B. No. 70) on June 30, 2011, that would prohibit the sale of products for young children containing bisphenol A (BPA). The law specifically applies to empty bottles and cups designed for use by children younger than age 4. The new law immediately prohibits manufacturers from selling or offering for sale children’s products containing BPA in Delaware, while retailers must stop selling them as of July 1, 2012. Not applicable to used products, the law is modeled on legislation and regulations adopted in eight other states and the city of Chicago since 2009.
