On April 27, 2009, U.S. Citizenship and Immigration Services (USCIS) updated its count of H-1B petitions received for the fiscal year 2010 program. Approximately 45,000 regular cap-subject petitions have been received toward the cap of 65,000 petitions. (Because of certain set asides under free trade agreements, effectively the regular cap has approximately 58,500 slots.) USCIS continues to accept general cap-subject petitions. For the cap of 20,000 on advanced-degree petitions, USCIS has received and counted 20,000 such petitions. However, because in the past USCIS has found that not all advanced degree petitions are approvable, the agency is continuing to accept advanced degree petitions.
