SFO speaks on DPAs: Alun Milford, General Counsel at SFO, has spoken on why companies might self-report corruption and why SFO cannot guarantee it will not prosecute. He stressed that SFO must show a case would meet the test to enable it to be prosecuted or the subject of a deferred prosecution agreement (DPA) in the first place, and that the court must then sanction any suggested DPA. He recommended that if in doubt companies should self-report, but warned of a tendency to refer to as a "self-report" items which in fact did not admit any guilt on the part of the company (but rather alleged wrongdoing of others) or were in response to an SFO request.
