On May 20, 2009, President Barack Obama released a Presidential Memorandum (Preemption Memorandum) stating the Obama Administration’s general policy with regard to Federal preemption of State law by executive departments and agencies of the Federal government (Agencies). It states that Agencies in recent years have sometimes announced that their regulations preempt State law without explicit preemption by the Congress or an otherwise sufficient basis under applicable legal principals.
