Claimant admitted to Defendant hospital following a diabetic coma. He weighed over thirty stone and suffered ankylosing spondylitis and arthritis. Whilst in hospital, his pressure-relieving mattress deflated and there was a delay in replacing it. He subsequently developed a severe grade 4 pressure sore on right buttock and remained in hospital for six months. Due to existing illness he would have required a lengthy stay however it was extended due to pressure sores. He received district nurse care for a further twenty-six months. Liability admitted for the delay in replacing mattress. Causation disputed. Trust challenged Claimant’s contention he would only have developed superficial pressure sores had he been treated appropriately.
Out of court settlement: £25,000 (estimated General Damages £22,000).
