On July 22nd, the Fifth Circuit vacated an injunction requiring Wells Fargo to audit every proof of claim it filed in that district in any case pending on or after April 13, 2007, provide a complete loan history on every case and amend its proofs accordingly. The injunction stemmed from the bankruptcy court's frustration with Wells Fargo's lawyers' lack of knowledge concerning the instant bankrupt homeowner's circumstances and months of inaccurate filings. Although the Fifth Circuit sympathized with the bankruptcy court's frustration, it vacated the injunction for lack of jurisdiction. Wells Fargo Bank, N.A. v. Stewart.
