The Swedish Competition Authority (“SCA”) proposed to the Stockholm Administrative Court that a fine of SEK 8.5 million should be imposed on SJ for having failed to follow the public procurement rules in awarding two contracts concerning cleaning services. SJ is a Swedish state-owned company that carries out passenger services by train. The value of the contracts in question is approximately SEK 56 and 60 million, respectively. The contracts were awarded directly because SJ does not consider itself to be subject to the public procurement legislation. The SCA, however, found that the operations of SJ are covered by the Act on Procurement within the Water, Energy, Transport and Postal Services Sectors and that the contracts in question exceeded the thresholds set in the Act.
