The Federal Communications Commission (FCC) has set September 22, 2009, as the deadline for the payment of this year's annual regulatory fees. Payments made after that date will be subject to a 25% penalty. Licensees may refer to the FCC's website for information concerning the Commission's regulatory fee payment procedures.

Radio and television licensees are required to pay a fee for all FCC authorizations held as of October 1, 2008, unless affirmative action to cancel a license was taken before October 1, 2008.

Cable licensees are required to pay a fee for all basic cable subscribers as of December 31, 2008, and all FCC authorizations held as of October 1, 2008, unless affirmative action to cancel a license was taken prior to October 1, 2008.

Licensees involved in a license assignment or transfer that was consummated after October 1, 2008, should note that the holder of the license at the time the regulatory fees are due will be responsible for payment.

The FCC will withhold action on any application or other requests for benefits filed by anyone who is delinquent on any non-tax debts owed to the Commission (including regulatory fees) and will ultimately dismiss those applications or other requests if payment of the delinquent debt or other satisfactory arrangement for payment is not made. Failure to pay regulatory fees can also result in the initiation of a proceeding to revoke any and all authorizations held by the delinquent payer.
