In decision of August 1, 2012, the Supreme Court of Justice reaffirms that personnel of management and confidence are entitled to the payment of nightly work surcharges.

The Court considers that even if management and confidence personnel have no right to the recognition of overtime work because of their classification, this does not mean that the increases generated by work at night are not recognized to these employees. From the Court's point of view, the exclusion of the maximum legal working hours established by law, only has the effect that this type of personnel, is not entitled to the payment of surcharges for overtime work.
