The Office of Fair Trading (OFT) agreed a provisional one year memorandum of understanding with Scotland's prosecuting body, the Crown Office in respect of the leniency shown to individuals for cartel offences. The Crown Office acts under the Lord Advocate who has sole responsibility for the investigation and prosecution of crime in Scotland. Previously, despite the OFT having the power to impose civil penalties in Scotland as well as England and Wales, it has been unclear whether individuals seeking leniency from the OFT in Scotland could still face prosecution from the Crown Office. This memorandum allows individuals applying for leniency to request an indication of their status from the Crown Office before revealing their identity.
