On October 18, 2011, the Commodity Futures Trading Commission (“CFTC”) adopted final regulations on position limits, revising the CFTC’s publication on January 26, 2011 of a proposed rule establishing a position limits regime for 28 exempt and agricultural commodity futures and options contracts and the physical commodity swaps that are economically equivalent to these futures and options contracts.
