The principle known as the rule in Re Hastings-Bass is not a correct statement of the law. In consequence, the scope for trustees to unscramble mistakes that have resulted in unintended consequences is restricted. Where, for example, a loss has been caused to a pension scheme because the trustees’ professional advisers gave incorrect advice, the trustees may now seek to recover their losses from those advisers (Pitt v Holt www.bailii.org/ew/cases/EWCA/Civ/2011/197.html).
