The UKBA has laid out a statement of changes to the Immigration Rules giving effect to the recent Supreme Court judgement in ZO (Somalaia) 2010.

The Rules provide that eligible asylum seekers and failed asylum seekers who are granted permission to work will only be entitled to take up employment in a job found on the shortage occupation list maintained by UKBA and are for the purposes of tier 2 (general) applications.

Asylum seekers and failed asylum seekers will not be allowed to be self-employed or engage in setting up a business.

The shortage occupation list can be found at http://www.ukba.homeoffice.gov.uk/employers/points/sponsoringmigrants/employingmigrants/shortageoccupationlist/

The new Immigration Rules will come into effect on 9 September 2010.
