In June 2006 a Judicial Mediation pilot scheme for employment cases was undertaken in order to test its effectiveness. This initiative was subsequently rolled out to all Employment Tribunals in Scotland, England & Wales. The Law Society has issued a Practice Note designed to guide solicitors appearing for clients in this type of mediation.
This Practice Note is available here and sets out how judicial mediation operates, when it is appropriate and the likely benefits of participation in the scheme. Although intended for solicitors, it is useful guidance to anyone who is considering using the Judicial Mediation service.
