On 24/06/2013, the Coana ´s Executive Declaratory Act no. 18 was published determining that foreign vessels admitted into the Brazilian jurisdictional waters destined to coastal navigation or cruise trips along the Brazilian coastline will be automatically subject to the temporary admission regime and waived from customs control required formalities.
This understanding was already prevailing among some companies of the segment on the grounds of article 5, item VII, of the Normative Instruction no. 285/2003, revoked on the occasion of the Normative Instruction no. 1.361/2013.
The Executive Declaratory Act has retroactive effects to May 21st, 2013, date on which the Normative Instruction no. 1.361/2013 came into effect and which currently sets forth provisions on the temporary admission regime.
