On September 1, 2008 the Hong Kong International Arbitration Centre (“HKIAC”) published the HKIAC Administered Arbitration Rules. These new rules will supersede the HKIAC Procedure for the Administration of International Arbitration. The new rules are available at the HKIAC’s website, www.hkiac.org.  

According to the HKIAC, the recommended arbitration clause for use of the HKIAC Administered Arbitration Rules is as follows:

“Any dispute, controversy or claim arising out of or relating to this contract, or the breach, termination or invalidity thereof, shall be settled by arbitration in Hong Kong under the Hong Kong International Arbitration Centre Administered Arbitration Rules in force when the Notice of Arbitration is submitted in accordance with these Rules.2 The number of arbitrators shall be ... (one or three).

“The arbitration proceedings shall be conducted in .... (insert language)."
