CRR own funds RTS published in OJEU: The Delegated Regulation supplementing the Capital Requirements Regulation (CRR) on regulatory technical standards (RTS) on own funds requirements was published in the Official Journal of the EU (OJEU) on 14 March. Commission adopts more CRD4 RTS: The Commission has adopted three further Commission Delegated Regulations containing RTS under the new Capital Requirements Directive and Regulation (CRD4/CRR). The Commission has now in total adopted nine RTS under these laws. Next they must pass the scrutiny of the co-legislators and then be published in the OJEU. The RTS just adopted cover: 

  • the requirements for investor, sponsor, original lenders and originator institutions relating to exposures to transferred credit risk;
  • the classes of instruments that adequately reflect the credit quality of an institution as a going concern and are appropriate to be used for the purposes of variable remuneration;
  • the definition of material exposures and thresholds for internal approaches to specific risk on the trading book.

Commission adopts TR fines Regulation: The Commission has adopted a Delegated Regulation based on the advice it received from ESMA, as required under the European Market Infrastructure Regulation (EMIR), on rules of procedure for penalties on trade repositories (TRs) and their right of defence.
