Part 6 of the rules has been extensively revised, with a number of incidental amendments elsewhere to reflect these changes. The changes come into force on 1st October 2008. One of the key changes is in respect of service of Claim Forms. A Claim Form will be deemed to be served on the second business day after “completion of the relevant step under rule 7.5 (1)”. The relevant step is “dispatching” for service.

If the Claim Form is posted/dispatched within the validity of the Claim Form (before midnight on the last day of the four month period from the date of issue), then it will be deemed served in time on the second business day after thereafter. It does not matter if the deemed date of service falls outside of the validity of the Claim Form. This rule will apply in respect of all Claim Forms where the four-month period expires on or after the 1st October 2008.
