The Arbitration (Scotland) Act 2010 has now been in force for one year. It is an exciting time for dispute resolution in Scotland and the Scottish Arbitration Centre is now up and running in the centre of Edinburgh.

The aim of the Centre is to promote arbitration both domestic and international and it brings together a number of organisations involved in dispute resolution in Scotland. (www.scottisharbitrationcentre.org).

As you will be aware, the legislation has specific confidentiality provisions and therefore it is almost impossible to assess whether there has been an increase in arbitration with the advent of the new Act. The preferred method of dispute resolution for particular situations needs to be considered both at contract stage and when any dispute between parties arises. We are happy to discuss options including but not limited to adjudication, meditation, litigation and of course arbitration.
