The Arkansas Department of Environmental Quality (“ADEQ”) and Sherwood Marble Company, Inc., (“SMC”) entered into a July 8th Consent Administrative Order (“CAO”) addressing alleged violations of the company’s air permit. See LIS No. 16-055.
The CAO provides that SMC owns and operates a cultured marble production facility in Jacksonsville, Arkansas.
The Jacksonville, Arkansas facility had been issued an air permit. See Air Permit 2078-AR-1.
The CAO provides that during an ADEQ review of SMC’s records it was determined that the company failed to maintain purchase records for the Gel Coat Material used at the Gel Coat Spray booth, the Resin used at the Resin Application Area, the Catalyst used at certain emission sources and the Aceton used at the Cleaning Area. It further states that SMC was unable to produce any purchase records for the Gel Coat Material, Resin, Catalyst and Aceton for the entire time period covered by the inspection. The failure to maintain these purchase records is alleged to inhibit ADEQ’s ability to determine compliance with certain specific conditions of the SMC Air Permit.
The CAO alleges that records reviewed during the inspection indicated that SMC exceeded the Permitted Hazardous Air Pollutant (“PHAP”) content limit for Cobalt 2-Ethylhexanoate (“12% Cobalt”). The permitted maximum content by weight for 12% Cobalt used in any Gel Coat Material at SM-01 is 0.45 percent.
SMC is stated to have provided in correspondence dated October 2, 2015, that it intends to cease marble production no later than October 9, 2015 and that it in fact had ceased production on October 1, 2015 requesting that Air Permit 2078-AR-2 be voided.
SMC agrees to a civil penalty of $500.
