The Supreme Court has ruled that, where an employee is dismissed by letter, the effective date of termination is the date the employee reads the letter. As a consequence the employee in question was able to bring an unfair dismissal claim within the three month time limit. The court noted that this would not have been the case had she deliberately failed to open the letter, as the contract of employment is terminated when the employee has had a reasonable opportunity to read the dismissal letter.
