Rovi withdraws yet another infringement claim and accepts that another patent should be revoked.

Virgin Media has won the latest patent battle by Rovi Corporation (NASDAQ: ROVI) against the Company. This is the eleventh successive defeat for Rovi, out of the eleven patent disputes with Virgin Media.

All of the eleven patents asserted by Rovi have now either been found invalid and/or revoked by either the English Court or by the European Patent Office (EPO) which was responsible for granting them. Judgments in respect of two of these eleven are still under appeal by Rovi and are due to be heard in the Court of Appeal by the end of the year.

The patent in this most recent revocation related to a TV programme guide using software and information downloaded from the Internet. Rovi has for the third time withdrawn its infringement claim shortly before trial and agreed to the patent’s revocation rather than have the patent tested in court. The claim has been dismissed by the Court with Rovi again ordered to reimburse Virgin Media’s legal costs.
