IP Court in its criminal judgment dated December 19, 2013 ruled that the defendant who posted a third party’s web address on his webpage is to make a third party access from his website to the others’ website, which does not meet the requirement of providing or transmitting “the content of goods” to the public as prescribed in the Copyright Act for the “public transmission”.  Further, the defendant lacked the intent to aid in the public transmission of unauthorized motion picture.  The IP court found defendant not guilty.
