NHS charges apply to all types of personal injury claims occurring after 29 January 2007. Before this time, recovery was limited to road traffic accident claims. Recovery of NHS ambulance charges also started after this date.
The level of the charges, and the maximum amount recoverable, has increased year by year. When the scheme was introduced in 1997, the daily charge for an outpatient was £295 and the maximum amount recoverable was £3,000.
The current daily charge for an outpatient is £566 and the maximum amount recoverable is £41,545, representing a very significant increase. As illustrated by one of the examples on the back page of this Briefing, Kennedys has had significant success in recovering NHS charges.
The amount of the charges to be repaid will depend on the date of the accident. The rates are as below.
