The Dallas Court of Appeals upheld a ruling by a Dallas trial court that excluded an expert’s testimony as unreliable. The City of Dallas was sued by Furgason and other individuals alleging they were exposed to Scourge, a mosquito control insecticide. The subject expert, Dr. Alfred Johnson, testified regarding causation but failed to rule out other possible causes of the injuries or to assess the level of exposure. The Dallas Court of Appeals held that the expert’s testimony was scientifically unreliable and, therefore, properly barred.
