As of January 6, 2007, most of the existing agency Boards of Contract Appeals (“BCAs”) were consolidated into a single Civilian Board of Contract appeals administered by the General Services Administration. Not included in the consolidation are the Armed Services Board of Contract Appeals, the Postal Service Board of Contract Appeals and the Tennessee Valley Authority Board of Contract Appeals.
The new Civilian Board of Contract Appeals, whose members consist of the full-time members of any of the consolidated agency Boards of Contract Appeals, will have jurisdiction to hear claims arising under the Contract Disputes Act (“CDA”). Additionally, the Civilian Board also may hear other, non-CDA matters that previously would have been decided by the agency boards, but only if the affected agencies permit. All cases pending in and all orders entered by the former BCAs prior to January 6, 2007, will be continued in and enforced by the new Civilian Board.
