FLASH! Federal judge in Texas does not enjoin a DOL rule. The way things have gone lately, the denial of a preliminary injunction against a rule issued by the U.S. Department of Labor may be more newsworthy than the granting of one. But Judge Sam Lindsay denied a request by a number of business groups to prevent the post-accident drug testing and retaliation provisions of the OSHA “Reasonable Reporting Procedures” rule from taking effect, which means the rule took effect yesterday.
