On November 8, 2011, the U.S. International Trade Commission issued a press release announcing that it voted to institute an investigation of Certain Electronic Devices With Graphics Data Processing Systems, Components Thereof, and Associated Software (Inv. No. 337-TA-813).
The investigation is based on a September 22, 2011 complaint and an October 14, 2011 amended complaint filed by S3 Graphics Co., Ltd. of the Grand Cayman Islands and S3 Graphics, Inc. of Fremont, California alleging violation of Section 337 in the importation into the U.S. and sale of certain electronic devices with graphics data processing systems, components thereof, and associated software that infringe one or more claims of U.S. Patent Nos. 5,945,997, 5,581,279, 6,353,440, and 5,977,960. According to the Notice of Investigation, the ITC has identified Apple Inc. a/k/a Apple Computer, Inc. of Cupertino, California as the sole respondent in this investigation.
Further, Chief ALJ Charles E. Bullock issued a notice indicating that E. James Gildea will be the presiding Administrative Law Judge in this investigation.
