The United States Environmental Protection Agency (“EPA”) Office of Inspector General (“OIG”) issued a September 19th Project Notification titled:

EPA Oversight of Delegated State Recourse Conservation and Recovery Act Programs

OIG states that it plans to begin preliminary research on the EPA’s oversight of authorized state hazardous waste programs that fall under the Resource Conservation and Recovery Act (“RCRA”).

Subtitle C of RCRA addresses the management and disposition of hazardous waste, used oil, and universal waste.

The State of Arkansas is a delegated state and has primacy for RCRA. The Arkansas Department of Environmental Quality administers the state’s hazardous waste program under the authority of the Arkansas Hazardous Waste Management Act.

OIG states its review will include the EPA Office of Resource Conservation and Recovery within the Office of Land and Emergency Management. It further notes that:

During preliminary research, our objective is to determine what oversight the EPA provides to ensure that states implement new RCRA regulations. The OIG plans to conduct work at ORCR in selected EPA regions.
