The U.S. Environmental Protection Agency (EPA) has published a notice of determination approving a petition by the New York State Department of Conservation (NYS DEC ) seeking to establish a Vessel Waste No Discharge Zone for Jamaica Bay and its upland islands and salt marshes. 76 Fed. Reg. 66,927 (10/28/11). In its petition, NYS DEC certified the need for greater protection of the water quality in the bay, which is bounded on the west and northwest by Brooklyn and on the north and northeast by Queens.

Seeking public input on its tentative affirmative determination in August 2011, EPA received 25 comments, 23 in favor of granting the petition and two questioning or opposing the No Discharge Zone. After considering the petition and the public comments, EPA finalized its affirmative determination.
