In brief

Thu Duc City was established pursuant to Decree 1111/NQ-UBTVQH14, effective on 1 January 2021, under the administration of Ho Chi Minh City, consisting of a complete merger of previous Districts 2, 9 and Thu Duc District. Thu Duc City's commune-level administrative units comprise 34 wards as in the previous districts, of which two wards are reorganized. 

The establishment and organization of Thu Duc City, of Ho Chi Minh City, is aimed at creating a new growth engine for Ho Chi Minh City, but it will introduce many administrative changes that will impact people and organizations located in the previous Districts 2, 9 and Thu Duc District.

Thu Duc City government

General

Thu Duc City consists of a complete merger of District 2, District 9 and Thu Duc District. Following the merger, the city now covers an area of 211.56 square kilometers  and has a population of 1,013,795. [1]

Commune-level administrative units consist of 34 wards. [2] Of these, two new wards are organized as follow: [3]

  • Thủ Thiêm Ward: a merger between Thủ Thiêm and An Khánh wards (previously in District 2). The new ward covers an area of 3.25 square kilometers  and has a population of 428.
  • An Khánh Ward: a merger between Bình An and Bình Khánh wards (previously in District 2). The new ward covers an area of 3.92 square kilometers  and has a population of 23,154.

On 27 January 2021, the Thu Duc City Party Committee announced the establishment of the People's Committee and personnel for Thủ Thiêm and An Khánh wards. [4]

Chair of the Thu Duc City People's Council, Nguyen Phuoc Hung, publicly emphasized that: "Thu Duc City only changed the name but the nature of the work does not change." [5] Therefore, the people's committees of the wards will continue to maintain administrative activities, without causing delays due to the transition, and to process regular daily work for individuals and businesses. Mr. Hung also directed the party committees of the wards to continue to perform political tasks as before. [6]

On 1 February 2021, the Thu Duc City Party Committee, consisting of five assisting agencies, and the Thu Duc City Party Office were established. [7] Other newly established government agencies of Thu Duc City, HCMC, include the People's Court and the People's Procuracy, established upon the dissolution of corresponding offices of District 2, District 9 and Thu Duc District. [8] Official appointments for the Thu Duc City People's Procuracy were publicly announced on 25 January 2021. [9]

Official establishment date of 22 January 2021 and projected timeline

A public announcement dated 21 January 2021 indicated that the system of agencies in Thu Duc City and its affiliated wards officially came into operation on 22 January 2021 [10] According to Ho Chi Minh City's Department of Home Affairs, the official establishment date is the same date as the first meeting of Thu Duc City's People's Council to elect positions for the people's council and the people's committee. [11] Therefore, on 22 January 2021  , local authorities in District 2, District 9 and Thu Duc District ended their terms, allowing Thu Duc City's government to take over all leadership, directive and administrative activities. [12]

Before 22 January 2021, the HCMC People's Committee projected that from 7 February to 23 May 2021 (election day of the National Assembly Legislature XV and the people's councils at different levels for the period 2021 to 2026) , the administrative apparatus of Thu Duc City will implement the instructions of departments and branches in implementing procedures for converting papers related to social security, business for individuals and organizations [13] On 25 January 2021, the HCMC People's Committee continued to instruct Thu Duc City's government to publicly coordinate at its administrative agencies, via newsletters and websites, as well as to assign civil servants to explain and instruct individuals and organizations on paperwork conversion. [14]

After 23 May 2021, local authorities will continue to improve the organizational apparatus following the XV National Assembly and people's councils elections and complete basic arrangements for civil servant and public employees. Arrangements at the higher level will continue to be developed to improve the effectiveness and efficiency of the management and administration of Thu Duc City. [15]

Administrative procedures

Effectiveness of seals/documents/change of agencies' signs

The seals of agencies, units and wards under the local governments of Districts 2, 9 and Thu Duc District ceased to be in effect as of 22 January 2021 . [16] The HCMC Department of Home Affairs was to instruct the Thu Duc City People's Committee on organizing the handover of the new seal and revoking the old seal before 25 January 2021  . [17] Before the revocation, the old seal was only used for completing documents related to compensation for clearance projects (e.g., inventory, counting and measurement). [18]

Pursuant to Decision 4764/QD-UBND, issued by the Ho Chi Minh People's Committee on 29 December 2020, Article 3, documents issued before 1 March 2021 by local authorities in Districts 2, 9 and Thu Duc District, will continue to be in effect if they have not been replaced or revoked.

According to Decision 4764/QD-UBND, Execution Plan, Article 6, agencies, units and wards affected by Decree 1111/NQ-UBTVQH14 will replace their seals by 28 February 2021 and change the names of their signboards in compliance with the new regulations by 25 February 2021 . 

Conversion of papers at no fee

According to Decision 4764/QD-UBND, people and organizations can request the relevant authorities (Department of Planning and Investment, Department of Transportation, city police, Department of Construction, Department of Natural Resources and Environment, etc.) to adjust their documents due to changes in the boundaries of administrative units from 1 March 2021, until completion, and they will not be charged.
