With the passage of Act 166 of 2016, effective January 17, 2017, Pennsylvania licensed breweries must now report to the Pa.L.C.B. the volume of malt or brewed beverages sold at their premises to consumers and self-distribution sales directly to retail. Additionally, importing distributor and distributor licensees must report all beer sold at wholesale. Brewers do not have to report sales to wholesalers. The reporting is required on a monthly basis, and must be filed no later than 60 days after the end of each calendar month. The reporting must show all volumes reported in 31-gallon equivalents, regardless of the package size. The Pa.L.C.B. is required to post the report online within 14 days of receiving it, and it must stay online for two years. Thereafter, the Pa.L.C.B. must retain the reports for a period of ten years.
The Pa.L.C.B. has issued a form via the PLCB+ online filing system. You can access the PLCB+ system through the Pa.L.C.B.’s website, www.lcb.pa.gov (place your cursor over “Licensees” and select “PLCB+”). Once you get to the next screen, log in to your account or register for an account. When you log in, there will be a link halfway down the page on the right that says “Submit Report.” Click on this link and supply the requested information. The form is very simple. You need to click “Add 1 Line” per manufacturer of beer that was sold on your premises or at wholesale. Then input the manufacturer’s name, the year and month you are reporting for, and the volume sold in 31-gallon barrel equivalents. Apparently this does not have to be broken down by brand or package. The form also allows you to view or update previous submissions.
As we are nearing the end of March, licensees are approaching some of the original deadlines for reporting. For example, using January 31 as the end of the first required reporting period, breweries, importing distributors, and distributors are required to file the report within 60 days, making the reports due on March 31, 2017, at the latest. The Pa.L.C.B. did not release any amended reporting deadlines.
