On 18 March 2013, the FSA published a consultation paper (CP13/8) containing proposals on how the Financial Conduct Authority (FCA) will use its new power under s.391(1)(c) of the Financial Services and Markets Act 2000 (“FSMA”) to publish information as it considers appropriate about Warning Notices. This marks a change towards earlier publication – at present, the FSA only publishes Decision Notices (issued after a party warned under a Warning Notice has had an opportunity to make representations to the FSA) and Final Notices. Comments on the consultation paper are due by 18 June 2013.
