In 1998 a pharmacist filed a complaint in relation to the action taken against him by the Tournai Body of Pharmacists for not respecting the Body’s rules on the modalities of the emergency service and regarding compulsory annual holiday of 15 days. According to the complainant, these rules had as their object or effect the restriction of competition in the Tournai region and its surroundings. However, the Competition Prosecutor ruled that the Body’s rules are only applicable to the territory of one commune or at the most to the territory of neighbouring communes and therefore that there was no effect on a substantial part of the Belgian market. On that basis, the Competition Prosecutor dismissed the complaint as unfounded.
