ACAS has revised its Guide on discipline and grievances at work and the ACAS Council has now approved it. The Guide accompanies the ACAS Code of Practice that is set to replace the existing statutory dispute resolution procedures from 6 April this year (see our E-Bulletin on the Employment Act 2008 and the ACAS Code.)
Failure to comply with the Guide will not in itself give rise to a claim. However, it will be taken into account in interpreting the provisions of the Code. To this end, employers should be familiar with its contents and should ensure that any disciplinary and grievance issues and all policies and procedures are compliant with its terms.
