The U.S. Citizenship and Immigration Services recently released a final regulation increasing the validity period of up to one year to a period of the TN category from a period of up to three years. However, the final regulation does not expand the concept of “dual intent" to the TN category. The final regulation does confirm that although “dual intent" does not exist in the TN classification, there is no specific limit on the total period of time a foreign national maybe present in the United States in TN status. The final regulation does not change the application procedures for Canadian or Mexican nationals applying for TN status. The final regulation became effective immediately when it was published on October 16, 2008.
