The most recent Form I-9 expired on August 31, 2012 – employers have been waiting six months for the new form. The new two-page form was released for public comment on March 27, 2012. It received so much criticism that its release was delayed and employers were told to continue using the expired form. Compared to the expired form, the new form is substantially longer and requires additional information. While release of the official version of the new form was rumored to be imminent, the latest word is that the form may be held to see whether comprehensive immigration form legislation progresses in the next months, as changes to the law could require additional changes on the Form I-9. Employers should prepare to change over to the new form sometime this year.
