The Directors of the SFO and of Public Prosecutions have published prosecutorial guidance to go alongside the MoJ guidance on adequate procedures under the Bribery Act. This guidance looks at factors that may make it more, or less, likely that particular situations where bribery occurs will be prosecuted. It also contains some guidance on the prosecutors' attitude to hospitality and facilitation payments, as well as on the jurisdictional reach of the Act. See further our newsflash.
