On June 18, 2013, the U.S. International Trade Commission issued a press release announcing their vote to institute an investigation of Certain Opaque Polymers (Inv. No. 337-TA-883).
The investigation is based on a May 20, 2013 complaint filed by Rohm and Haas Company of Philadelphia, Pennsylvania, Rohm and Haas Chemicals LLC of Philadelphia, Pennsylvania, and The Dow Chemical Company of Midland, Michigan alleging violation of Section 337 in the importation into the U.S. and sale of certain opaque polymers that infringe one or more claims of U.S. Patent Nos. 6,020,435; 6,252,004; 7,435,783; and 7,803,878. According to the Notice of Investigation, the Commission has identified the following entities as the respondents in this investigation:
- Organik Kimya San. ve Tic. A.S. of Turkey
- Organik Kimya Netherlands B.V. of the Netherlands
- Organik Kimya US, Inc. of Burlington, Massachusetts
- Turk International LLC of Aptos, California
- Aalborz Chemical LLC of Grand Rapids, Michigan
The Notice of Investigation also indicates that the Office of Unfair Import Investigations will not participate as a party in this investigation.
Lastly, Chief ALJ Charles E. Bullock issued a notice indicating that Thomas B. Pender will be the presiding Administrative Law Judge in this investigation.
