On 24 August 2010 the Competition Commission (“CC”) announced that it will be carrying out a short review of how it conducts telecoms appeals. The CC has been dealing with three telecoms cases this year concerning a dispute on pricing issues, following two cases during 2008/09 in relation to mobile termination charges. Given its recent experience, the CC has decided that it is an appropriate time to review how it carries out this type of appeals and whether there is scope to make the CC’s process more effective and efficient. The CC will contact a range of parties with an interest in the appeals process such as telecoms companies, Ofcom, the Competition Appeal Tribunal and the Department for Business, Innovation and Skills, to seek their views.
