A transferor is required under TUPE to provide the transferee with certain specified information about transferring employees (employee liability information) in advance of the transfer. This information included details of any disciplinary or grievance proceedings in the two years prior to the transfer to which the statutory disciplinary and grievance procedures applied. As a consequence of the repeal of the statutory procedures, Regulation 11 of TUPE has been amended with effect from 6 April, so that information instead has to be given about disciplinary or grievance proceedings to which the ACAS Code of Practice applied.
