Despite efforts by a number of industry groups, the EPA will not extend the comment period for the Advanced Notice of Proposed Rulemaking (ANPR) concerning the regulation of greenhouse gases under the Clean Air Act. Multiple industry groups sent a letter to EPA Administrator Johnson requesting that EPA extend the comment period 45 days. The letter was signed by the National Association of Manufacturers, the American Chemistry Council, the Edison Electric Institute, the National Mining Association, and a few other organizations. The 120-day comment period for the ANPR was a “relatively long period” according to Meyers, and it will not be extended. The agency will, however, post late comments to the docket, and they could be considered if the agency does in fact proceed with a rulemaking, which is not likely to happen under the current administration but may occur more quickly under the Obama administration.
