In September, the Department of Homeland Security submitted an interim final regulation to the Office of Management and Budget (OMB) for review. If it becomes final, this regulation will eliminate certain documents from the lists of documents that employers may accept as proof of employment eligibility for I-9 purposes. Because the text of the regulation is not yet available, it is unclear which documents will be removed or otherwise affected. For the proposed regulation to take effect, it must first be reviewed by the OMB and then published in the Federal Register. The regulation would then take effect within 30 to 60 days after publication. Seyfarth Shaw will keep clients updated on the progress of the regulation.
