The EAT has confirmed for the first time that a man can claim equal pay comparing himself with a woman who is claiming equal pay.
Such a claim can be submitted before the woman's claim has been decided and, if she is successful and a tribunal award made, the man may be entitled to arrears of pay for the same period as the woman comparator.
The employer's failure to offer the same settlement terms to men with piggyback claims as had been offered to the women was also held to be unlawful sex discrimination. Leave to appeal has been given. (McAvoy v Llewellyn, EAT)
