The deadline for the payment of the mandatory fee due to the Italian Competition Authority (the Authority), discussed in our Hot Topic of 4 September 2012, and 1 October 2012, is 30 October 2012.  If payment is late, the Authority won’t impose a fine, but will levy statutory interest until the date the payment is received.

Payment must be made by bank transfer to the Autorità Garante della Concorrenza e del Mercato at Banca Nazionale del Lavoro, account number 000781, IBAN code IT25 V010 0503 2390 0000 0000 781, specifying the corporate name of the entity subject to the fee and the tax code number.

Proof of the payment must be sent to the Authority by 30 November 2012, at contributo.agcm@pec.agcm. from a certified email account (PEC), using the form available on the Authority’s website.

For companies affected by the earthquake in Italy in May 2012, the deadline for paying the fee has been postponed to 30 November 2012.  In order to qualify for this extension, however, these companies  must, by 30 October, send the Authority the documents that certify they fulfill the requirements set out in Law No 122 of 1 August 2012.
